AN ORDINANCE OF THE TOWN OF HACKETTSTOWN AMENDING SCHEDULE XV OF CHAPTER 13 (ENTITLED “TRAFFIC AND PARKING”) OF THE TOWN ORDINANCES ESTABLISHING RESTRICTED HANDICAP PARKING ON MADISON STREET
WHEREAS, pursuant to N.J.S.A. 39:4-197.5, a municipality is authorized to enact ordinances restricting parking spaces in front of residences for use by persons who have been issued special vehicle identification cards by the New Jersey Division of Motor Vehicles pursuant to N.J.S.A. 39:4-205; and
WHEREAS, the Town currently prohibits and regulates the parking of motor vehicles on Town streets as set forth in Chapter 13 of the Code of the Town of Hackettstown; and
WHEREAS, the Mayor and Council has received a request from a resident to designate a parking space on Madison Street, by the intersection with Grand Avenue, as restricted to parking by a person who has been issued a special vehicle identification card pursuant to N.J.S.A. 39:4-205; and
WHEREAS, the Mayor and Council, in the interest of public safety and order, wishes to restrict the first parking spot east on Madison Street at the intersection of Grand Avenue and Madison Street.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Common Council of the Town of Hackettstown, County of Warren, State of New Jersey, as follows:
Section One: Pursuant to Section 13-19 of the Town Code, entitled “Handicap Parking”, Schedule XV of Chapter 13 is hereby amended to restrict the first parking spot on Grand Avenue at the intersection of Madison Street, so the Schedule shall read as follows:

Section Two: The Town may designate the above Handicap Parking restriction by painting the curb and/or posting signs.
Section Three: If any section, subdivision, paragraph, clause, or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to such section, subdivision, paragraph, clause, or provision and the remainder of this ordinance shall be deemed valid and effective. All ordinances or parts of ordinances inconsistent with this ordinance are hereby repealed to the extent of such inconsistency.
Section Four: This ordinance shall become effective upon final passage and publication according to law.
Notice is hereby given that the aforesaid ordinance was introduced at a regular meeting of the Common Council of the Town of Hackettstown, New Jersey, held on June 11, 2020, and that at a regular meeting of the same to be held on July 9, 2020 at the Municipal Building, 215 Stiger Street, Hackettstown, New Jersey, at the hour of 7:00 p.m., the said Common Council will conduct a public hearing and will consider the final passage of said ordinance.
